These Terms of Service ("Terms") govern your access to and use of the Project Forge website at projectforge.fun (the "Platform") and the street food delivery services offered through it. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform. These Terms constitute a binding legal agreement between you and Project Forge, operating from 3915 W 26th St, Chicago, IL.
The Platform is provided for the purpose of facilitating food delivery orders between customers and participating food vendors. You may use the Platform only for lawful purposes and in accordance with these Terms.
You agree not to use the Platform in any way that violates applicable federal, state, or local law or regulation. You agree not to transmit any material that is defamatory, offensive, or otherwise objectionable. You agree not to attempt to gain unauthorized access to any part of the Platform or its related systems.
We reserve the right to terminate or restrict your access to the Platform at any time, without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, vendors, employees, or the Platform itself.
When you place an order through the Platform, you are entering into a transaction with the participating vendor for the preparation of food and with Project Forge for the delivery service. Your order constitutes an offer to purchase the specified items at the listed prices.
Delivery is available to addresses within the designated service area. Orders placed outside the service area may be declined. Delivery time estimates are provided as general guidance and are not binding commitments. Actual delivery times may vary due to traffic, vendor preparation time, weather, and other factors outside our control.
Payment for orders is accepted as cash on delivery. You agree to have the correct amount available when the driver arrives. Failure to pay upon delivery may result in your order being returned and your access to the Platform being restricted.
A delivery fee of $3.99 applies to orders with a subtotal below $25.00. No delivery fee applies to orders with a subtotal of $25.00 or more. These amounts are subject to change with notice.
Project Forge operates as a delivery intermediary. The food you order is prepared by independent vendors who are not employees or agents of Project Forge. Project Forge does not prepare food and is not responsible for the quality, safety, or accuracy of food prepared by vendors.
Vendors are responsible for compliance with all applicable food safety regulations, health codes, and licensing requirements in their jurisdiction. Project Forge does not inspect, certify, or warrant the food safety practices of any vendor.
Menu items, prices, and availability are determined by individual vendors and are subject to change without notice. Project Forge makes reasonable efforts to keep the Platform menu current but does not guarantee that all listed items will be available at the time of ordering.
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Project Forge does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Project Forge does not warrant the accuracy, completeness, or timeliness of any content on the Platform.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you in full. In such cases, the implied warranties are limited to the extent permitted by applicable law.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PROJECT FORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR THE SERVICES.
Project Forge's total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid for the specific order giving rise to the claim.
This limitation applies regardless of the theory of liability, whether based in contract, tort, strict liability, or otherwise, even if Project Forge has been advised of the possibility of such damages.
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in Cook County, Illinois, for the resolution of any disputes arising from these Terms or your use of the Platform.
Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute informally by contacting Project Forge at info@projectforge.fun. We will make good faith efforts to resolve the dispute within 30 days of receiving your notice.
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Material changes will be communicated through a notice on the Platform.
Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.
It is your responsibility to review these Terms periodically. We encourage you to check this page whenever you use the Platform.
